Complete Terms and Conditions 

Design:

Each cake is custom-designed by Blue Skye Bakery. Therefore, cakes will never look exactly like a photo provided for inspiration. We reserve the right to alter any structural or aesthetic elements of the cake without notice in order to create the design and determine the level of replication. The client understands that copyrighted images will not be duplicated under any circumstances.

Blue Skye Bakery will provide one design consultation free of charge for weddings and large events. Consultations with a tasting must be booked in advance. After the design and flavors are finalized, any subsequent changes will include a $50 redesign fee. Tastings are $20 and can either be picked up or provided during a consultation. The cost of the tasting will be deducted from the final price of the cake when the order is booked.

Blue Skye Bakery reserves the right to use any photographs or likenesses of your cake for display or promotion without compensation to you as the client.

Allergens:

Our facility is not allergen-free; therefore, we can't guarantee against an allergic reaction. In addition, all our cakes are produced in a shared environment with milk, wheat, nuts, and soy. Therefore, we also do not currently offer any gluten-free options.

Deposit and Payments:

All orders will require a non-refundable 25% deposit when booking. Your order is not considered final without a deposit. Final payment on orders can be made upon pickup. Delivered orders will require the balance to be paid two days prior to your event. Large Events and Weddings will also require a signed contract.

Delivery:

Orders within Vermilion Parish can be delivered. Please contact us for delivery fees and conditions.

Late Pickup Policy:

All pickups will be considered late after a 15-minute grace period and incur a $.50 per minute late fee.

Your order will not be released to you until the fee is paid.

Changes to orders:

No changes (flavors, designs, etc.) will be allowed on specialty cake orders less than two weeks prior to orders to ensure we can provide you with the highest quality products. If in the event a change is allowed, it may incur additional costs. All orders are considered completely final one week prior to your event.

Cake Storage:

We work hard to create a beautiful and delicious cake that will be the centerpiece of your party! After the cake is picked up or delivered, it's your responsibility to have a safe and appropriate spot for your cake away from unnecessary heat and humidity, which can have severely adverse effects on buttercream and fondant. We recommend refrigeration for overnight storage and extended periods of time, especially in warm weather. Cakes can be brought to room temperature and displayed for a few hours in a climate-controlled room.

Adverse weather conditions (heat, rain, humidity) will affect the look of the finished product. Cake condition will not be guaranteed in this situation or outdoors in any weather condition. You are responsible for providing an appropriate and secure table and environment for the cake. Cakes are heavy and require a sturdy table and an optimal room temperature of 73 degrees or below.

Decorations:

All decorative items being provided to us (figurines, ribbons, etc.) must be dropped off a week prior to the event and should be labeled with your name and event date. The only exception is fresh flowers: they must be dropped off one or two days before. Blue Skye Bakery holds the right to charge a fee for putting props on the cake.



  • It is understood that any items brought into Blue Skye Bakery, LLC, to be added to a cake for decoration are to be used at the bakery's discretion.

  • It is understood that any ribbon added to the cake will darken in color due to the butter content in the icing. Satin ribbon with no wire works best on cakes. Ribbon that is added to a tiered cake will be provided by the client unless the bakery agrees to supply ribbons.

  • Detail work out of frosting on the cake may not be possible in certain colors due to the risk of bleeding from high humidity in late spring to early fall.

  • Any items used to add decoration to the cake, such as cake toppers or other figurines, will be added at the event site. However, if, once at the site, the cake toppers or figurines do not seem stable enough to leave on the cake, Blue Skye Bakery, LLC reserves the right to leave them off the cake in order to ensure the structure and stability of the cake.

  • In the rare event that an outside party damages the cake after we have left the event site, contact us immediately. If possible, a Blue Skye Bakery representative will return to fix any damage for a fee that will be assessed according to the damage made.

  • Blue Skye Bakery, LLC is not responsible for any items added to the cake after delivery or any damage done to the cake once it is delivered and set up. Do not move the cake once it is set up.

  • It is ultimately understood that Blue Skye Bakery, LLC knows what their product can uphold as far as decoration and will do as much as in their power to create the envisioned cake.

  • The colors black, blue, purple, hot pink, red, or any shade of these colors cannot be guaranteed. These colors are unstable and may fade and /or bleed into surrounding areas. Dark colors may stain teeth and have residual flavor, and we determine color match quality.

  • If fresh flowers are placed on the cake without our knowledge we are in no way responsible for food safety. You acknowledge that fresh flowers are not a food item and may contain pesticides, dirt, insects, or other contaminants.

 

Blue skye bakery is not responsible for any aspect of the cake after it has been deemed satisfactory upon delivery or pickup. Poor road conditions, improper transportation methods, and careless driving by the client may damage the cake. If you or your representative elect to pick up, transport, and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves BLue Skye Bakery.

Cancellations:

  • Due to our products' tedious, handcrafted nature, we cannot provide refunds or exchange custom cakes, cake pops, cupcakes, or cookies. Therefore, we only give refunds in accordance with the refund policies stated below.

  • If you need to postpone or reschedule your cake order, we require at least 30 days' notice for weddings, 7 days for large events, and 5 days for small events. If we do not receive adequate notice, you may incur an extra charge to recreate the elements on the cake. If you cancel your order more than 30 days in advance, you will receive a refund for the balance, less the non-refundable retainer fee and 25% handling fee.

  • In the event of unavoidable situations such as a hurricane, blackout, fire, or any other Act of Nature, no refunds will be given, and you may reschedule for a full store credit. This includes the unfortunate nature of the COVID-19 global pandemic.

Refund Policy:

  • If you place a retainer on an order and you cancel, no refunds will be given.

  • Cake flavor and texture are subjective. Therefore, refunds requested due to flavor or texture after the cake has been accepted and picked up will not be honored. You may qualify for store credit if the product is brought back to us and the quality of the cake flavor or texture is determined not to meet our standards (Our cakes are tasted daily to ensure the highest possible quality). Quality determination is solely at the discretion of Blue Skye Bakery, LLC. Our cakes are baked from scratch with the best quality ingredients possible and need to be kept out at room temperature for at least two hours prior to serving. Keep in mind that variety in temperature and humidity may impact the cake's flavor, overall design, or texture to some degree. Please understand that we cannot control changes in texture, color, or shape due to weather conditions. We do not freeze our cakes, nor do we deliver frozen cakes.

The following 3 scenarios are the only instances when we will provide a full or partial refund:

  1. If we fail to deliver your cake on the date and time stated on your contract for your wedding or event. For example, if we deliver the cake up to 2 hours late, we will not provide a refund. Further, if the customer provides the wrong date, time, or address for delivery or inadequate directions, we will not provide a refund. We will not be responsible for any additional expenses you incur due to our failure to deliver the cake. Our liability is limited to the contracted value of the cake.

  2. If you choose to pick up your order and the cake does not meet your expectations, we will give you a refund minus a 25% handling fee. This refund will be in place of a check. No cash or credit card refunds will be given. If you choose a refund, you cannot keep the cake, and we will not negotiate a partial refund if you keep the cake. This is a "take it or leave it" policy. We are not responsible for any expense you may incur for replacing our cake.

  3. If we deliver the cake to you and the cake does not meet your expectations, we will give you a refund minus a 25% handling fee. If you request a refund at the time of delivery, you cannot keep the cake, and we will take it with us. We will not negotiate a partial refund if you keep the cake. This is a "take it or leave it" policy. We are not responsible for any expense you may incur for replacing our cake.

We do not give refunds under any other circumstances. Refunds are given within 7 days.

Disclaimer:

In the case of an emergency or an error in your cake delivery, please contact us immediately so we can fix the issue right away! If you are unhappy with your cake for any reason, call us (do not email) on the day of your event and explain the situation. Without proof that you are indeed unhappy with the product and will not be using it for your event, we will be unable to refund any portion of your payment. This is necessary to hinder the rare case of the "if we complain, we'll get a free cake" issue we occasionally encounter. We are dedicated to satisfying our clients!
